What is a whiplash injury?
A whiplash injury is damage to the soft tissue in the neck, back or shoulder caused by ligaments and muscles being stretched beyond their limit because of a sudden impact or jolt. Older people, particularly with arthritis, are more vulnerable to this sort of injury.
What are the symptoms of whiplash?
Although not always noticed immediately, the affects of a whiplash injury usually become noticeable a few hours after an accident in the form of a headache and feeling of stiffness or hot sensation in the back of the neck. Swelling and dizziness are also symptoms. This pain or discomfort may mean you cannot turn your head from side and may spread to your arms and shoulders.
How much compensation can you get for whiplash?
The amount of whiplash injury compensation you can claim was newly defined in the Civil Liberties Act introduced on May 31st 2021. The compensation for whiplash you can receive is calculated based on the length of time you suffer from your injuries. There are fixed compensation tariff amounts for ‘Pain, suffering and loss of amenity’, for example 3-6 months injury is awarded £495. Whiplash compensation can be awarded up to £4345 if you also suffer psychological injuries.
How long do I have to claim for a whiplash injury?
Generally, a whiplash claim can be made up to three years after the date of the accident. For children under 18 a claim can be made any time until they turn 21 years of age.
