Surgery Claims
If you have had an operation which has not gone smoothly you may be entitled to claim compensation if the complications have been the result of surgery negligence.
Whether your experience occurred within the NHS system or a private healthcare provider, you may be assured to know that if you are awarded compensation, it is paid for by their liability insurance.
Frequently Asked Questions
What are common types of negligent surgery claims?
Most surgery is safe, however, the use of laparoscopic (keyhole) surgery has led to an increase in claims, for example, of surgical instruments being left inside patients and awards for nerve damage compensation. Other types of surgical negligence include operating on the wrong limb in the case of amputation, infection due to poor sterilisation, damage to other organs and performing the wrong type of operation.
Can I Claim Compensation For A Surgical Error?
We can help you claim for surgery negligence or compensation for nerve damage after surgery if mistakes are made during the course of your operation or in the after-care you receive
What are the time limits for making a surgical negligence claim?
Generally, a claim for negligence in surgery can be made up to three years after the hospital or clinic has treated you or the date on which you were aware of the problem. For children under 18 a claim can be made any time until they turn 21 years of age. There are no time limits on making a claim if a patient is unable to make the claim themselves due to mental incapacity, either resulting from the surgery or pre-dating it, while they are incapable.
